1. Agreement to these terms
These terms are an agreement between you and EverLabs Software Ltd ("EverLabs", "we", "us"), which provides EverSafe ("the Service"). Registered in England and Wales, company number 17079363. Registered office: 37 Brimstone Road, Ashford, TN26 2FA, United Kingdom. By using the Service you agree to these terms. If you don't agree, please don't use the Service.
2. The Service
EverSafe provides cloud backup for Windows computers, including:
- automatic backup of your files to secure cloud storage;
- file versioning and restore from earlier points in time;
- client software for Windows 10 and Windows 11;
- an online account for managing your computers and subscription.
3. Your account
Creating an account
You need an account with a valid email address and password to use the Service. You are responsible for keeping your sign-in details confidential.
Your encryption password
You must also create an encryption password, separate from your sign-in password, which is used to encrypt your files. We cannot recover your encryption password or decrypt your files if you lose it. You accept that losing your encryption password means permanently losing access to your backed-up data.
Account security
You are responsible for all activity under your account. Tell us straight away if you think someone has used your account without permission.
4. Subscriptions and payment
Plans
The Service is provided on a subscription. Plan details, including storage limits and features, are shown on our pricing page.
Billing
Subscriptions are billed monthly, in advance. A yearly subscription taken out before yearly plans were withdrawn continues to be billed yearly. Payments are processed by Stripe. Prices are in pounds sterling (GBP) and include any applicable VAT.
Automatic renewal
Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.
Refunds
We offer a 14-day money-back guarantee on new subscriptions. If you're not satisfied, contact us within 14 days of your first payment for a full refund. After 14 days, refunds are at our discretion.
5. Acceptable use
You agree not to use the Service to:
- store illegal content;
- break any law or regulation;
- infringe anyone's intellectual property rights;
- distribute malware or malicious software;
- try to gain unauthorised access to our systems;
- interfere with the Service or other users.
6. Your data
Ownership
You keep all rights to your data. We claim no intellectual property rights over what you back up.
Encryption
Your data is encrypted with AES-256-GCM on your device before it is uploaded. We use zero-knowledge encryption, which means we cannot access, read or decrypt your files.
Where it's stored
Your encrypted data is stored in data centres in the European Union.
7. Availability
We work to keep the Service available at all times but can't guarantee uninterrupted access. We may carry out maintenance, with notice where possible. We are not liable for downtime or interruptions.
8. Limitation of liability
To the fullest extent permitted by law:
- the Service is provided "as is", without warranties of any kind;
- we are not liable for data loss, including loss caused by a forgotten encryption password;
- our total liability is limited to the amount you paid us in the 12 months before the claim;
- we are not liable for indirect, incidental or consequential losses.
9. Ending the Service
By you
You can cancel your subscription at any time from your online account. The Service continues until the end of the period you've paid for.
By us
We may suspend or close your account if you break these terms. If we close it for that reason, no refund is due.
Your data afterwards
Cancelling your subscription stops new backups at the end of your paid period but does not delete your existing backups; you can still sign in and restore them. If you delete your account, or we close it, your backups and account data are permanently deleted 15 days later.
10. Changes to these terms
We may change these terms. We'll tell you about significant changes by email or through the Service. If you keep using the Service after a change, you accept the new terms.
11. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
